These conditions are concluded between the company Bajoia and people wishing to make a purchase via the website www.bajoia-bijoux.com, hereinafter called “the customer”.

Bajoia undertakes to respect all the provisions of the Consumer Code relating to distance selling.

The command

Obligation

The fact, for a customer, of completing the order form and confirming it constitutes full and complete acceptance of these general conditions of sale, which he then accepts without any reservation. In the event of an entry error, Bajoia cannot be held responsible for the consequences which could result, such as delay or error in delivery. The costs incurred by the reshipment would then be the responsibility of the customer.

Products and compliance

The photographs visible on the site present Bajoia products but do not enter into the contractual scope. Indeed, each stone is unique in its shape, color and luster, which make it a unique piece. Mother-of-pearl also has a multitude of reflections that vary greatly from one piece of jewelry to another. Exact non-conformity with the photographs on the site cannot therefore give rise to any compensation, reimbursement or exchange of the product. The photos of the jewelry on the site are retouched.

Validation

Validation constitutes signature and express acceptance of all operations carried out on the site.

Product availability

In the event of force majeure (unavailability of the product, stock shortage, strike, floods, fire, riots), Bajoia will not be held responsible for non-performance of the contract concluded. Bajoia undertakes to inform the customer, by email or telephone. Therefore, within 30 days, the customer may request cancellation and reimbursement or exchange of the order from Bajoia.

The product

Non-compliance of the delivered product

In the event of non-conformity of the delivered good compared to that chosen when ordering and with presentation of the latter's e-mail, the customer has the possibility of contacting Bajoia within 7 days (from receipt of the package) in order to inform them by email of the situation.

Price

The prices of the items are indicated in euros, all taxes included, excluding shipping costs. Bajoia reserves the right to modify prices at any time but items will be invoiced based on the prices in effect at the time your order is placed.

Payment

The customer can pay for their purchases by credit card or by Paypal, transfer or check made out in €, payable to Bajoia, addressed to Bajoia 26 rue de Percy 92140 Clamart – France. In the case of payment by check, it must be issued by a bank domiciled in mainland France.

The merchandise will be shipped upon confirmation of receipt.

In the event of default or payment dispute, Bajoia reserves the right to terminate the sale automatically, without notice or delay and may possibly require the return of the product, at the customer's expense.

Warranty and after-sales service

Guarantee

The warranty concerns manufacturing defects or material defects. It excludes damage resulting from contact of the jewelry with aggressive agents such as cosmetic products, perfumes, household products, detergents and other corrosive products. Bad conditions of use, shocks or normal wear and tear are not covered by the warranty. In accordance with current legislation, chains and bracelets include an open and deliberately weak link, which prevents any risk of snagging. The opening of this link and its deformation following inappropriate tension are therefore excluded from the guarantee.

After sales service

All Bajoia jewelry is guaranteed for 6 months.

Bajoia offers the customer the opportunity to benefit from the guarantee against hidden defects which would render the product unfit for use. The latter must inform Bajoia by e-mail in order to know the procedure for sending the product. Bajoia then undertakes to repair or exchange the said product, subject to stock availability at the time of the exchange request.
Allow an average of 10 days for after-sales service.

Withdrawal rights

In accordance with the provisions of article L. 121-20-12 of the French Consumer Code, the customer has 14 completed calendar days from the date of delivery, to return the product in its original packaging, to his own costs, under return conditions identical to those of the initial shipment. This does not apply to personalized jewelry. The customer agrees to contact Bajoia by e-mail or telephone, before any shipment, in order to obtain the return address.

All products must be returned to Bajoia in new condition and suitable for resale. Any product damaged, incomplete or with damaged or missing packaging will not be refunded or exchanged.

In compliance with this commitment on the part of the customer, Bajoia then undertakes to reimburse the latter within 30 days following receipt of the return.

Protection of personal data, freedom and IT

In accordance with French law n°78-17 of January 6, 1978 relating to data processing, files and freedoms, the customer has the right to access, consult, modify and delete personal data concerning him or her. .

Intellectual property

All elements of the Bajoia site are protected by copyright. The models are registered with the INPI. They are the exclusive property of Bajoia.

The Customer acknowledges that Bajoia jewelry and the distinctive signs (image, photographs, packaging, product names, etc.) are the exclusive property of Bajoia.

The Customer is prohibited from any act of reproduction or use of product models, packaging, brands or distinctive signs, inventions, techniques or know-how used by Bajoia, as well as any act tending to the appropriation of these elements, whether whether or not they are the subject of protection by Bajoia by a patent, trademark, registered design or model or copyright.

Dispute

In the event of failure, between Bajoia and the customer, to resolve their dispute amicably (interpretation or application of these conditions of sale), the courts of Nanterre (France) will have sole jurisdiction.
